AI is not a future initiative for law firms. It is already influencing daily work.
An associate uses a public AI tool to refine a brief before sending it to a partner. A practice group experiments with AI to summarize deposition transcripts. A software vendor activates new AI features during a routine platform update. No announcement. No formal rollout. No executive discussion.
Meanwhile, firm leadership may still be asking, “Should we explore AI?” But the more relevant question is: “Where is AI already being used inside our firm, and who is accountable for oversight?”
If you do not know where AI is operating in your environment, you do not have a strategy. You have unmanaged exposure.
AI Adoption in Legal Is Measurable and Growing
AI use in the legal profession is no longer theoretical.
The ABA Legal Technology Survey Report reflects growing awareness and experimentation with AI tools among attorneys. Adoption varies by firm size and role, but usage is increasing.
This is consistent with broader workforce trends. Pew Research Center highlights how AI tools are entering professional workflows quickly, often without formal enterprise governance. McKinsey’s research on generative AI and knowledge work points to meaningful productivity impact across drafting, analysis and research functions. In other words, the core work of a law firm.
Across industries, the pattern is similar: Individual professionals experiment first. Governance follows later. In law firms, that gap matters even more. Client confidentiality, ethical duties and reputational exposure are not theoretical concerns. They are central to the business model. This is not primarily a technology discussion. It is a leadership and risk discussion.
The Real Risk Is Unmanaged Use
The issue is not that AI exists. It’s that AI may be operating without structure.
In many firms, there is:
- No written AI usage policy
- No approved and vetted tool list
- No guidance on what client data can or cannot be entered
- No executive sponsor accountable for oversight
That is not an AI strategy. It is default behavior. From a risk standpoint, three areas require immediate attention.
Client confidentiality
Public AI tools differ in how they store, process and retain data. If attorneys enter identifiable client information into a tool without understanding its data policies, firms may be exposing sensitive information. The NIST AI Risk Management Framework emphasizes governance, risk identification and transparency in AI systems. Those principles apply whether a firm builds a custom solution or uses a public platform.
Ethical competence
The ABA Model Rules make clear that technological competence is part of professional responsibility. See ABA Model Rule 1.1, Comment 8. If AI tools are being used for drafting, research or client communication, firms must ensure outputs are accurate, verified and aligned with professional obligations. Reliance without review is not defensible.
Operational and reputational impact
Hallucinated citations are the most public examples, but quieter risks are just as important. Inconsistent internal standards, unclear review processes and undocumented tool usage create inefficiency. Clients are beginning to ask how firms use AI and how their data is protected. An unclear answer signals governance gaps.
Most firms cannot confidently answer three basic questions: What tools are in use, what data is being entered and who is accountable for oversight. That is the exposure.
AI and Firm Economics
AI can absolutely improve efficiency. When it is used correctly, it can reduce drafting time, accelerate research and improve responsiveness. But unmanaged AI use does not automatically translate to margin improvement. It can create rework, quality concerns and client trust issues. It can also complicate malpractice exposure if usage standards are inconsistent.
The goal is not to slow innovation. It is to ensure innovation supports profitability and protects the firm’s reputation at the same time. That requires structure.
Shadow AI Is the New Shadow IT
Law firms have navigated similar moments before. When cloud file sharing tools first appeared, professionals adopted them because they made work easier. Governance lagged. Over time, firms did not eliminate demand. They implemented policies, approved platforms and oversight mechanisms. AI is following the same path.
Attempting to block every public tool is unlikely to succeed. Ignoring usage is worse. Professionals will continue to experiment, especially under pressure to deliver work faster. The practical path forward is structured governance, not avoidance.
What Law Firm Leadership Should Do Now
Firms do not need a lengthy strategy document to make progress. They do need clarity and ownership.
Start with these concrete steps:
Conduct a structured AI usage inventory
Use a short internal survey and direct conversations with practice group leaders. Ask specifically about drafting tools, research assistants and features embedded in existing platforms. Review administrative settings within core platforms such as Microsoft 365 to understand which AI capabilities are already enabled.
Establish clear interim guardrails
Until tools are vetted, prohibit entry of identifiable client data into public AI platforms. Require that all AI-generated content be reviewed by a licensed attorney before external use. Document approved tools and acceptable use cases in writing.
Assign executive sponsorship
AI governance cannot sit in a gray area between IT and firm leadership. Designate a named executive sponsor responsible for policy, oversight and alignment with firm risk management.
Integrate AI into existing governance structures
Incorporate AI oversight into your broader information security, compliance and risk management processes. Align it with your cloud governance and data protection policies. Treat AI as part of your operational risk profile, not a side experiment.
If your firm currently has no written AI guidance, that is a governance gap. If AI use is occurring without executive sponsorship, that is a leadership issue, even if it feels unintentional.
This Is a Leadership Decision
AI is already influencing how legal work is drafted, reviewed and delivered. The question is not whether your firm is using AI because it almost certainly is. The real question is whether leadership is comfortable with the current level of visibility, accountability and oversight.
Ignoring AI does not reduce risk, but governing it does. If you are unsure where AI is already showing up inside your firm, that is not a failure. It is simply the starting point for a more structured conversation.
It is far easier to set guardrails now than to explain gaps later.
